Terms of Service

1. Acceptance of Terms

By accessing or using ZewstID (“the Service”), including our website, APIs, SDKs, documentation, and any related services, you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Service Description

ZewstID is a cloud-based identity and authentication platform that provides:

• OAuth 2.0 and OpenID Connect (OIDC) compliant authentication and authorization services
• Software development kits (SDKs) for Next.js, React, React Native, and Node.js
• RESTful APIs for user management, authentication, and identity operations
• A developer portal with documentation, application management, and analytics
• An administrative dashboard for managing users, applications, and security policies
• Support for multiple authentication methods including passwords, magic links, one-time passwords, WebAuthn/passkeys, push authentication, and social login providers

ZewstID reserves the right to modify, update, or discontinue any aspect of the Service at any time with reasonable notice to users.

3. Account Registration

To use certain features of the Service, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information to keep it accurate and current
• Maintain only one account per individual person; duplicate accounts may be suspended or terminated
• Keep your login credentials confidential and not share them with any third party
• Accept full responsibility for all activity that occurs under your account
• Notify ZewstID immediately of any unauthorized access to or use of your account

ZewstID reserves the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Abuse, disrupt, or interfere with the Service or its infrastructure, including through denial-of-service attacks or excessive automated requests
• Circumvent, disable, or otherwise interfere with rate limits, security features, or access controls
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service, except as permitted by applicable law
• Gain or attempt to gain unauthorized access to the Service, other user accounts, or any related systems or networks
• Use the Service to store, transmit, or distribute malicious software or code
• Resell, sublicense, or redistribute the Service without prior written consent from ZewstID
• Use the Service for any purpose that is fraudulent, deceptive, or harmful to others

ZewstID reserves the right to investigate and take appropriate action against any violations of this section, including suspending or terminating your account and reporting violations to law enforcement authorities.

5. API Usage & Rate Limits

Access to the ZewstID API is subject to rate limits based on your subscription plan:

Requests exceeding your plan's rate limit will receive an HTTP 429 (Too Many Requests) response. Persistent or intentional rate limit violations may result in temporary or permanent suspension of API access.

Usage exceeding your plan's included Monthly Active Users (MAU) will incur overage charges as described in your billing terms and on the Pricing page. ZewstID will notify you when your usage approaches your plan limits.

6. Intellectual Property

ZewstID and its licensors retain all right, title, and interest in and to the Service, including all software, APIs, SDKs, documentation, trademarks, service marks, logos, and other intellectual property associated with the Service. These Terms do not grant you any right to use ZewstID's trademarks or branding without prior written consent.

You retain full ownership of your applications, data, and content that you create or manage using the Service. ZewstID does not claim any intellectual property rights over your applications or end-user data. By using the Service, you grant ZewstID a limited license to process your data solely as necessary to provide and improve the Service.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. By using the Service, you consent to the data practices described in the Privacy Policy.

ZewstID implements industry-standard security measures to protect the data processed through the Service, including encryption in transit and at rest, regular security audits, and access controls.

8. Service Availability

ZewstID uses commercially reasonable efforts to maintain the availability and reliability of the Service. However, the Service may be subject to interruptions due to maintenance, updates, infrastructure issues, or circumstances beyond our control.

• Free tier: The Service is provided on a best-effort basis with no guaranteed uptime or service level agreement (SLA).
• Pro tier: Includes a 99.9% uptime SLA as described in the plan terms.
• Enterprise tier: Custom SLA terms are available as part of your enterprise agreement, up to 99.99% uptime.

ZewstID will provide reasonable advance notice for scheduled maintenance that may affect the Service. Emergency maintenance may be performed without prior notice when necessary to protect the security or integrity of the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

ZewstID shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if ZewstID has been advised of the possibility of such damages.

In no event shall ZewstID's total cumulative liability to you for all claims arising out of or related to these Terms or the Service exceed the greater of (a) the total amount you paid to ZewstID during the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

10. Termination

Either party may terminate these Terms at any time:

• By you: You may terminate your account at any time through the account settings or by contacting support. Termination will take effect at the end of your current billing period.
• By ZewstID: We may suspend or terminate your account immediately if you violate these Terms, or with 30 days notice for any other reason.

Upon termination:

• Your right to access and use the Service will immediately cease
• Your data will be available for export for 30 days following termination
• After the 30-day export period, ZewstID may permanently delete your data
• Any outstanding fees owed to ZewstID will remain due and payable

Sections relating to intellectual property, limitation of liability, and any other provisions that by their nature should survive termination will remain in effect after termination.

11. Changes to Terms

ZewstID reserves the right to modify these Terms at any time. For material changes, we will provide at least 30 days advance notice via email to the address associated with your account or through a prominent notice within the Service.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must discontinue your use of the Service before the changes take effect. The most current version of these Terms will always be available on this page.
